In the Name of God Amen. I Mary Rymill of the Parish of Frome Selwood in the county of Somerset widow being sick and much indisposed of and calling to mind the uncertainty of this present life do make and ordain this my last Will and Testament in manner following (that is to say).
First of all I give to John Stammoff of the parish of Frome Selwood aforesaid Yeoman and to Anthony Rymill of Frome Selwood aforesaid clothier all that my tenement or dwelling house with xxx garden and appurtenances to the same belonging and all my roofless tenement called Trollops and barn within the parish of Corsley in the county of Wilts containing three closes of pasture or arable land being about six acres of ground to have and to hold the same tenements closes and premises to them the said John Stammoff and Anthony Rymill their Executors Administrators and Assigns during all my estates and farms to come of and in the same. Nevertheless to and for the several uses following and to and for none other use, uses or intents or purposes whatsoever (that is to say) that they the said John Stammoff and Anthony Rymill and the survivor of them and the Executors, Adminstr and Assigns of such survivor shall and will raise out of the rents, income and profits of the same estates the sum of thirty shillings yearly and every year during the natural life of my daughter Hannah the now wife of George Withey and pay the same thirty shillings yearly at the most usual round in the year by even and equal portions into the proper hands of my said daughter Hannah during the term of her natural life for her sole and separate use, maintenance and benefit so as not to belong or go to the use of or any way lyable or subject to or affected with the alienation debts, forfeiture, release, receipt, charge incumbrance and disposition, demand or power of her husband.
And in trust further that they and the survivor of them or the Executors, Administrators or Assigns of such survivor do and shall raise out of other the rents, issues and profits of the same tenements money sufficient to pay off all principal and interest due on a mortgage of that part of the premises called Trollips for fifteen pounds principal money and all charges my said trustees shall be put to or sustain in or about the execution of the said premises and from and after the said principal money interest and charges shall be paid off then upon trust further that the said John Stammoff and Anthony Rymill and the survivor of them do and shall permit and suffer my son James Rymill his Executors, Administrators but not his Assigns to have hold and enjoy the same tenement called Coaless and roofless tenement called Trollops with the appurtenances and take the rents issue and thereof to his and their own use during the then residue of the several farms I have to come of and in the same charged as aforesaid and subject to the rents.
And if the said thirty shillings yearly payable as aforesaid to my said daughter Hannah Withey shall be in arrears or unpaid by the space of twenty days next after twenty ninth day of September and the twenty fifth of March yearly it shall and may be lawful to and for my said daughter Hannah or her Assigns to distrayne for the same arrears and the distress all distresses on the same estates so taken to lead, drive, take, carry away, detain, keep, apply and dispose of in like manner as may be of a distress or distresses for rent.
Also I give unto my son James Rymell my cupboard in the parlour, my least brass kettle, the little table board in the parlour, my soft flock bed and bedstead thereto belonging and bedding to the same and my hanging press in the outer chamber my coffer and box in the inner chamber and one pillow.
Also I give to my son-in-law George Parrott one shilling of lawful money of Great Britain.
Also I give unto my son-in-law George Withey one shilling of like money.
Also I give and to my daughter Sarah Holdway one shilling of like money and my scarlet coat
Also I give to the three sons of George Parrott (that is to say) Michael Parrott, John Parrott and Samuel Parrott thirty pounds of like money being ten pounds apiece in two years next after my decease to be paid if they shall be then of the age of one and twenty years and if either of them dye before he obtain to that age then the share and interest of him so dying shall go and be to the use of the survivors.
Also I give and to my grandsons Thomas Cary and Daniel Cary one shilling each of like money.
Also I give unto my granddaughter Sarah Garrish my black cloth coat.
Also I give to my daughter Hannah Withey my new bell metal pot, my greatest brass kettle, the table board in the press house, one little tub, one treadle, my long table board in the hall, my chest in the outer chamber, one quarter barrel, one pillow, my warming pan and also all my wearing apparel not before therein given which said goods and apparel I give to my said daughter Hannah to make her satisfaction for her attending me in my sickness if she accept it as such and not otherwise.
And also I give unto my son James Rymill, my daughter Sarah Holdway and to Hannah Wihey my three least gold rings to take their choice of them as hereinafter mentioned (viz) Hannah to take first Sarah next and James last.
Also I give unto my sons Anthony Rymill, James Rymill and my daughter Hannah Withey all my pewter to be divided between them share and share alike.
Also I give and to my friend John Stammoff and to my son Anthony Rymill five shillings each whom I appoint to be trustees of this my last will desiring them to see that the same may be duly fulfilled Also I give and bequeath unto my son Anthony Rymill (whom I likewise constitute make and ordain sole Executor of this my last will and testament) all the rest and residue of my estate, goods, chattels and credits not before herein given and disposed of by him my said son Anthony Rymill freely to be possessed and enjoyed.
And I do hereby utterly disallow, revoke all and every other former Testaments, Wills, Legacies, Bequests and Executors by me in anywise before this time named or willed or bequeathed ratifying and confirming this and none other to be my last Will and Testament.
In witness whereof I the said Mary Rymill have to this my last will and testament contained in two sheets of paper set my hand and seal the first day of March in the ninth year of the reign of our sovereign Lord George the Second by the grace of God of Great Britain, France and Ireland King defender of the faith and in the year of our Lord 1735 Signed Mary Rymill. Signed, sealed, published and declared by the said Mary Rymill the testatrix as and for her last Will and Testament in our hearing and presence and then subscribed and attested in the presence of the said testatrix by us Joseph Stor (signed) Mary Stor.
This will was proved at London the first day of October in the year of our Lord one thousand seven hundred thirty six before the worshipful Robert Houlder Doctor of Laws surrogate to the Right Worshipfull John Bettersoon Doctor also of Laws Hereafter Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oath of Anthony Rymill the son and sole Executor named in the said Will to whom Administration of all and singular the goods, chattels and credits of the said deceased being first duly sworn to administer.
